Greg Freemyer-Chief Technical Officer/Norcross Group
A Co-Founder of Norcross Group, Greg Freemyer drives the technological underpinnings of Norcross Group’s offerings, and directs complex data collection and preservation operations for litigation support. He has submitted Expert Reports in Federalcases as a Computer Systems Expert, and has been accepted as an
Expert Witness in Federal Civil Court, and specifically accepted asan Expert Witness on ESI Collection. He has testified as a technical ESI expert on spoliation matters.
 
Tim Wells-eDiscovery Specialist-EMC/Kazeon
Tim has 29 years of experience in the Information Technology industry, the last 13 with various divisions of EMC. Tim has been configuring Archiving, Compliance & Information Management solutions for the past 8 years. He is experienced in both pro-active and re-active electronic discovery and information collection. Tim provides end-user solutions to identify, retain, preserve, analyze, cull and deliver Electronically Stored Information quickly and accurately from many data sources, including email systems, historical archives, laptops & desktops, file shares and content repositories such as SharePoint and Documentum.

Topic

With litigation matters involving large numbers of custodians the litigation hold process can be especially complex.  This session starts with an overview of the legal issues associated with litigation hold and delves into the relatively recent "University of Montreal Pension Plan v. Banc of America Securities" ruling from Judge Scheindlin.  In particular Judge Scheindlin specifies situations in which failing properly perform the litigation hold process qualifies as gross negligence.

After, the legal discussion, the Kazeon eDiscovery Appliance will be briefly demonstrated with specific focus on the Litigation Hold notification and collection features of the appliance.  Litigation Hold notification tracking capability in particular is an emerging new need in the eDiscovery space and few tools yet exist to address it in large, complex matters.  The demonstration will focus on the general features that litigants should consider as they choose their litigation hold notification tracking solution.
